Who gets my money if I don’t have a Will?

Your assets are distributed in accordance with laws set by the government, often in a different way than you would want. You also lose control over who acts as the Executor of your estate, which is a position involving significant responsibility.

Example: Lets take a husband and wife, John and Carol who have three young children. The family home is in Carol’s name only for tax purposes. Carol dies without a Will. Under the law, John is entitled to the first $100,000 of Carol’s estate, plus 1/3 of the rest. The other 2/3 goes to their children. In order to meet this 2/3, it is likely the family home will have to be sold: an outcome Carol never would have wanted!
